General conditions of sale of the site www.goldbeaute.fr
The company GOLDBEAUTE, a limited liability company, registered in the Soissons Trade and Companies Register under number 798 693 800, whose registered office is located at 611 rue des moines 02200 Villeneuve saint Germain (hereinafter referred to as “ GOLDBEAUTE »).
These General Conditions of Sale (hereinafter the “GCS”) apply to all sales concluded by GOLDBEAUTE on the site www.goldbeaute.fr (hereinafter the “Site”).
The fact, for any customer of the Site (hereinafter the “Customer”) of ordering products sold by GOLDBEAUTE (hereinafter the “Products”) on the Site implies its full and unreserved acceptance of these General Terms and Conditions, which prevail over any other specific conditions of the Customer, in particular its general conditions of purchase, unless prior written exemption from GOLDBEAUTE. . GOLDBEAUTE reserves the right to modify the T&Cs at any time, the latter being applicable as soon as they are posted online, excluding current transactions.
1. PROFESSIONAL QUALITY
1.1 The site is exclusively reserved for professionals. As such, the Client must provide the company name and first and last name when registering on the Site.
1.2 The Customer undertakes to make purchases on the Site (hereinafter “Purchases”) solely for the needs of his professional activity.
2. REGISTRATION ON THE SITE
2.1 Any Purchase made on the site is subject to the creation of an account by the Customer. The latter must imperatively provide the contact details allowing the processing of his orders (invoicing, delivery) by GOLDBEAUTE, notably :
The company name and, where applicable, the SIRET number,
His first and last name,
His postal address and his email address
2.2 The Client undertakes to update this information as soon as a change occurs in his contact details.
2.3 Finally, the Customer must choose a username and password (hereinafter the "Identifiers") that he/she will be required to reuse for his/her future Purchases on the Site. The Customer undertakes to keep his/her Identifiers secret and not to disclose them to any third party. The Customer is solely responsible for accessing the Site using his/her Identifiers, unless he/she provides proof of fraudulent use that is not attributable to him/her.
3. CONCLUSION OF THE SALES CONTRACT
3.1 The Products are presented on the Site with a description allowing the Customer to know their essential characteristics and their price.
3.2 The availability of a Product is indicated on its description sheet. The product may be “in stock” or “being restocked”. GOLDBEAUTE makes its best efforts to ensure the accuracy of the availability of a product. However, it cannot be held liable if such information proves to be inaccurate.
3.3 The Customer selects the Product(s) he/she wishes to purchase.
3.4 He confirms his choice of Product(s) by validating his basket and acknowledges and accepts these General Terms and Conditions by clicking to validate.
3.5 The Customer then proceeds to pay for his order under the conditions set out in article 4 of the T&Cs.
3.6 Once the payment has been validated, the Customer receives an email confirming receipt of their order (hereinafter the “Order Confirmation”).
3.7 In the event of unavailability of the Product, GOLDBEAUTE undertakes to inform the Customer of this when processing the order in the Order Confirmation referred to in point (3.6) above. In this situation, GOLDBEAUTE may either offer the Customer a similar or equivalent product, or offer to cancel the order, or indicate a new delivery time. In the event that the Customer has ordered several Products, only the contract relating to the sale of the unavailable Product is covered by the aforementioned provisions.
3.8 If the product is available,GOLDBEAUTE in fact makes a firm commitment to ship the Products .
4. PRICE AND PAYMENT
4.1 The prices of the Products are expressed in Euros, and are inclusive of all Taxes.
4.2 The applicable VAT rate is that in force at the time of validation of the order.
4.3 The details of the taxes applicable to the sale of the Product are indicated when viewing the basket.
4.4 Orders are paid in cash, using one of the following payment methods:
by Paybox 3D Secure bank card (Visa, Mastercard, Carte Bleue, American Express) ;
by bank transfer
through the Customer’s Paypal account.
4.5 Payments are made through an online payment operator, the company PAYBOX E-TRANSACTION. All payments made on the Site are subject to secure processing using the SSL encryption protocol.
5. ORDER CONFIRMATION
5.1 Once the order and payment have been validated, GOLDBEAUTE sends a confirmation email to the Customer with a summary of their order, including in particular:
Billing address and shipping address,
The quantities and designations of the items ordered,
For each product: the price H.T. & the applicable VAT rate,
The total price H.T. applicable taxes (including VAT)
The total price T.T.C.
5.2 Unless proven otherwise, the data recorded by GOLDBEAUTE constitute proof of all past transactions carried out between GOLDBEAUTE and the Client.
6. SHIPPING METHODS AND COSTS
6.1 When validating the basket, the carrier is automatically chosen
For small hairdressing equipment and accessories, delivery is made by Colissimo or GLS
For furniture, delivery will be made by carrier, namely GLS, DASHER, HEPPNER DSV, TRANSPORT SELLIER
Some items will be available for collection, to find out if the item ordered is available for collection contact us at 03.23.54.88.20
6.2 Delivery is free in Metropolitan France*, Belgium, Poland, Luxembourg, Italy, Spain, Austria and Denmark
For other countries such as Switzerland, customs fees may be required and remain the responsibility of the customer.

6.5 Once the Product has been shipped, GOLDBEAUTE will inform the Buyer by sending an email, providing them with the delivery tracking number, where applicable.
7. DELIVERY
7.1 Delivery is carried out by a carrier mandated by GOLDBEAUTE. Deliveries are made to the ground floor only.
7.2 The Products are delivered to the address indicated by the Customer in his “Personal Space”. It is therefore the sole responsibility of the Customer to ensure that the information he communicates to GOLDBEAUTE for this purpose are and remain correct and that they will allow him to receive the Products he purchases on the Site. In the event of inaccuracy of the delivery address communicated by the Customer, the Products will be reshipped at the latter's expense.
7.3 Delivery takes place by handing over the Products to the Customer against signature of a delivery note. In the event of the Customer's absence on the day of delivery, a delivery notice will be left in their mailbox. In order to take possession of the Products, the Customer must contact the carrier whose contact details will appear on the delivery notice.
7.4 Delivery times for France vary from 2 to 7 days (depending on the department, excluding weekends and public holidays).
Delivery times for Belgium vary from 5 to 9 days (excluding weekends and public holidays).
Delivery time for Switzerland varies from 10 to 12 days (excluding weekends and public holidays).
Delivery times to Italy and Spain vary from 10 to 13 days (excluding weekends and public holidays).
The delivery times mentioned on the Site are only indicative and may be subject to change.
In case of non-receipt of a package within the indicated time, an investigation is carried out with the carrier and can take several days (e.g.: 21 days with the Post Office and the carrier). During this period, no refund or return can be made.
Late delivery does not entitle the Customer to any compensation.
8. RETENTION OF TITLE
8.1 GOLDBEAUTE retains ownership of the Products, the transfer of which is subject to full payment of their price. GOLDBEAUTE thus reserves the right to claim the return of the Products in the event of non-payment by the Customer of the full price.
8.2 On the other hand, the risks are transferred to the Customer upon receipt by the latter of the Products.
8.3 The Customer shall not give as security the Products subject to this retention of title clause. It undertakes to notify all its creditors of this retention of title clause.
9. RIGHT OF WITHDRAWAL
9.1 Notwithstanding the Client’s professional status, GOLDBEAUTE grants him the benefit of a right of withdrawal. Thus, for any Purchase made on the Site, the Customer has a period of fourteen (14) days from receipt of the Product(s) ordered to exercise, with GOLDBEAUTE ,his right of withdrawal, without having to provide justification or pay a penalty (hereinafter the “Right of Withdrawal”).
9.2 By way of derogation from the foregoing, the Right of Withdrawal does not apply to:
Personalized Products or custom-made products ;
Products that have been installed ;
Products opened and non-returnable for reasons of hygiene or health protection (in particular products intended for contact) ;
9.3 In the event of exercising the Right of withdrawal within the aforementioned period, the price of the Product(s) subject to the right of return will be refunded, with the return costs remaining the responsibility of the Customer.
9.4 Products subject to the right of withdrawal must be returned within fourteen (14) days following the exercise of this right, in their original condition (except normal wear and tear) and complete (packaging, accessories, instructions, etc.) in the same packaging as that used during shipping (cardboard, bubble wrap, polystyrene, etc.).
9.5 GOLDBEAUTE will then proceed to reimburse the Products concerned by the Right of Withdrawal by re-crediting the bank card or Paypal account used for the order, as soon as possible and at the latest within fourteen (14) days following the date on which the right was exercised. The reimbursement of the Products concerned will only take place after their receipt and verification by the returns department GOLDBEAUTE.
9.6 Subject to the following articles 10 & 11, after the period of fourteen (14) days, the goods will neither be returned nor exchanged.
9.7 For any order cancelled during delivery, 10% of the total amount including tax on your invoice will be deducted from your refund. These costs correspond to bank commissions, order preparation and shipping costs.
10. GUARANTEES
The warranty on all our products is a 1-year manufacturer warranty, unless otherwise indicated in the product sheet.
It is limited to the replacement of a defective part or item. Concerning hairdressing chairs, barber chairs, hydraulic tables, stools, only the pump is guaranteed. Concerning beauty tables, massage tables, spa chairs, pedicure chairs and all other furniture, the covering is excluded from the guarantee.
During the immobilization of the equipment, the warranty does not provide for any replacement equipment to replace defective equipment, and the customer will not be able to claim any compensation.
The total or partial impossibility of using the products, in particular due to hardware incompatibility, cannot give rise to any compensation or reimbursement or to the questioning of liability. GOLDBEAUTE
The repair does not change the initial warranty date.
Disclaimer of Warranty
Excluded from the warranty:
- replacement of consumables, wear (plastic parts, plastic covers, welds, seals, shower heads, remote controls, etc.)
-corrosion, oxidation, poor connection or external power problem. For example, if a connection is made to a faulty socket, the warranty will not apply.
- unusual or incompatible use of the products
- accessory failures (power cord), failures and their
consequences due to an installer/repairer not approved by the seller,
- defects and their consequences resulting from improper use
for which the product is intended.
Warranty varies from item to item. Warranty is not guaranteed under conditions of storage, installation, use and
normal maintenance is not followed.
- Damage to the Product resulting from its normal wear and tear with regard to its nature, function and composition
Any defects in the Product that may result from improper installation, storage, conservation, or assembly (non-compliance with the assembly instructions), lack of maintenance, improper use or use that does not comply with the technical or usage specifications (non-compliance with maintenance and upkeep instructions), modifications or repairs carried out by the Customer or a third party, damage caused by external objects, external events such as accidents, impacts, fires, acts of vandalism, water damage, natural or artificial light (in the event of discoloration of fabrics and coverings), natural disasters or bad weather
Excluded from the Guarantee are damages caused directly or indirectly by:
damage originating from a cause external to the product, such as, and without this list, which is only an illustration, being exhaustive: shock, fall, misuse, prolonged use of electrical devices (overheating), handling error, burns, discoloration in light, humidity, excessive heat, cuts, scratches, any impregnation by a liquid.
-Damage resulting from failure to follow maintenance instructions (Stain caused by the use of cleaning products or chemicals.)
- Damage resulting from failure to comply with an installation or assembly that does not comply with the manufacturer's recommendations
-Deterioration of furniture and its contents, or any other furnishing product, resulting from the breakage of the wall support
For furniture, defects in appearance linked to a difference in color, and/or to the structure of the wood, differences in color linked to restocking, variations in color due to the influence of light over time.
-Damage does not affect the proper functioning of the device, in particular aesthetic damage: Chair covers, beauty tables, tattoo tables, spa pedicures..., covers and cushions including buttons, snaps, zippers, seams, paint and coverings...
scratches, scrapes, traces of impact on the cabinetwork or enamel, smoker's accident, and the following parts: lamps, indicator lights, water inlet pipe and seal, drain pipe, mirror, exterior windows, cover, any accessory in general unless they are the direct consequence of damage of internal origin guaranteed.
-Normal wear and tear such that it does not affect the daily use or safety of the product.
-Damages involving the liability of a third party or resulting from intentional or wilful misconduct.
-Remote controls and memory cards for electrical equipment etc.
-The cost of cleaning the products if this proves necessary to carry out the repair.
- Elements or accessories that require regular replacement (batteries, lamps, bulbs, filters, etc.).
-Replacement of lighting lamps, connecting cables between devices, etc.
-Damage occurring during transport or moving of the product carried out by the customer or one of their representatives under their responsibility.
- Relative costs and/or damage caused by poor quality of the product power supply: faulty electrical voltage, voltage error, filter cleaning, etc.
- Warranty exclusions related to the nature of the damage (indirect damage):
The warranty only covers the right to repair or replace the product covered by the warranty. Therefore, indirect damages resulting from failure or deterioration in quality are not covered by the warranty.
Return costs remain the exclusive responsibility of the buyer.
The warranty is not valid if payment has not been made.
Please keep the original boxes during the warranty period, because without the packaging and inner protection (polystyrene), no item will be picked up.
Products returned incomplete, soiled, damaged or without original packaging and protection (polystyrene) and labels will not be accepted.
Maintenance clause
The delivered goods remain the property of the company. GOLDBEAUTE Awaiting payment

Failure to reimburse any of the payments gives us the right to file a complaint.

Notwithstanding other provisions, in the event of failure by the buyer to comply with any of the deadlines
Payments, GOLDBEAUTE without prejudice to his other rights, he may obtain by letter
recommended return of the equipment at the buyer's expense until completion by the buyer
the last of all commitments. Law No. 85.98 of January 25, 1985, article 121
VALIDITY OF THE WARRANTY
The benefit of the Guarantee will only be granted upon presentation of the product purchase invoice.
The Warranty will only be acquired by the first purchaser and only applies to new devices.
11. DISPUTES - CONTESTATIONS
Reservations with the carrier
11.1 In the event of transport damage or missing goods, the Customer shall be required (i) to issue any specific and reasoned reservations (i) upon receipt on the waybill in the presence of the carrier or (ii) within three (3) days following delivery by registered letter with acknowledgement of receipt addressed to the carrier, in accordance with Articles L133-3 et seq. of the French Commercial Code. The Customer must also send a copy of these reservations to GOLDBEAUTE. In the absence of reservations within the time limit, the goods will be deemed to have been received in good condition.
Damaged or non-compliant product
11.2 The Customer has the possibility to report in his account, within thirty (3) days from receipt of the order, any complaint concerning the Products ordered, according to the following criteria:
Non-compliant product: the Product received does not correspond to the Product ordered (and provide sufficient proof of the damage affecting the Product (in particular photographs).
Damaged Product: The Product received is broken or damaged and provides sufficient evidence of the damage affecting the Product (including photographs).
11.3 If the Customer's claim is well-founded, the dispute declared by the latter will give rise, depending on the case,
either to the exchange of the Product ordered,
either to its reimbursement by GOLDBEAUTE.
11.3.1 If the Product is non-compliant, the Customer must return the Product concerned in the condition in which it was received, in its original packaging, with all the elements accompanying it (accessories, packaging, instructions). GOLDBEAUTE and the Customer will jointly choose the appropriate mode of transport for this return, depending on the volume and weight of the product.
11.3.2 If the Product is broken or damaged: the Customer must, at the request of GOLDBEAUTE :
Either return the Product concerned in the condition in which it was received, in its original packaging, with all the elements accompanying it (accessories, packaging, instructions); GOLDBEAUTE and the Customer will jointly choose the appropriate mode of transport for this return, depending on the volume and weight of the Product.
and provide sufficient proof of the damage affecting the Product (including photographs).
11.4 In the event of return by the Customer of the Product concerned, reimbursement will only take place after its receipt by GOLDBEAUTE.
Product not received
11.5 The Customer has the possibility to report, within twenty-one (21) working days from the Order Confirmation, the non-receipt of the Product.
11.6 If it is proven that the non-receipt by the Customer is not due to a delay, the dispute declared by the Customer will give rise to the reshipment of the Product.
11.7 If it is proven that the non-receipt is due to a delay not attributable to GOLDBEAUTE, , GOLDBEAUTE will communicate a new receipt date to the Customer.
11.8 If it is proven that the non-receipt is due to a delay attributable to GOLDBEAUTE, the Customer will have the choice between:
Cancellation of the order resulting in its reimbursement,
Determination of a new delivery date.
12. RESPONSIBILITY
12.1 GOLDBEAUTE is only responsible for the content of the pages it publishes. The photographs illustrating the Products are provided for information purposes only.
12.2 GOLDBEAUTEShall not incur any liability for any indirect damages, whether consequential or not, resulting from these, loss of business, loss of profit, loss of opportunity, damages or costs, which may arise from the purchase of the Products. The total or partial impossibility of using the Products cannot give rise to any compensation or reimbursement or questioning of the liability of GOLDBEAUTE. The responsibility of GOLDBEAUTE is limited, for all causes combined, to a sum, which is capped at the amounts of the sums collected for the supply of the Products.
13. INTELLECTUAL PROPERTY
13.1 All texts, comments, works, illustrations, works and images reproduced or represented on the Site are strictly reserved under copyright and intellectual property law, for the entire duration of protection of these rights and for the entire world. Any total or partial reproduction or representation of the Site or of all or part of the elements found on the Site is strictly prohibited.
13.2 Any copy or reproduction by any process whatsoever would constitute an infringement punishable by the penalties provided for by the Intellectual Property Code.
13.3 The trademarks appearing on the Site are the property of their owner and any use not authorized by the latter would constitute an act of counterfeiting.
14. PERSONAL DATA
14.1 The Client expressly accepts that individual data concerning him/her may be subject to computer processing by GOLDBEAUTE under the conditions defined below:
GOLDBEAUTE collects and sorts, by computerized systems, the Client's individual data with the aim of improving the relationship GOLDBEAUTE-Client on the basis of market studies and to advise the Client of promotional operations ;
Access to the Client's data is limited to persons authorized to carry out data processing, security and IT maintenance operations ;
The Client has the right to access and rectify computerized data concerning him/her ;
The Customer may at any time cancel the authorization granted above and object, for legitimate reasons, to the processing of his/her individual data by GOLDBEAUTE.
15.NO WAIVER
15.1 The fact that one of the Parties does not avail itself of a breach by the other Party of any of the obligations referred to in these General Terms and Conditions cannot be interpreted as a waiver of this obligation.
16.PARTIAL NULLITY
16.1 If one or more provisions of these General Terms and Conditions are held to be invalid or declared as such pursuant to a law, regulation or final decision of a competent court, the other provisions shall retain their full force and scope.
17. APPLICABLE LAW
17.1 These General Terms and Conditions are subject to French law, to the exclusion of the provisions of the Convention. In the event of a dispute between GOLDBEAUTE and the Client, the competent jurisdictions will be those of the jurisdiction of the registered office of GOLDBEAUTE.
